4. DATA PROCESSING ROLES (CLIENT VS. INTERVIEWEE DATA)

  • Company as Data Controller: Testimonial Pros acts as a Data Controller for personal information collected directly through our website, sales interactions, and billing channels.

  • Company as Data Processor: When capturing video interviews, names, and likenesses of our Clients' customers/interviewees, Testimonial Pros acts strictly as a Data Processor operating on behalf of our Client (the Data Controller). Our Clients maintain full operational control over how final media assets and interviewee statements are used, published, and distributed.

5. HOW WE SHARE YOUR INFORMATION

We do not sell, rent, or trade your personal information to third parties or data brokers. We only share information under the following limited circumstances:

  • With Clients: Video interviews, transcripts, names, and likenesses collected during a production campaign are delivered directly to the sponsoring Client for their business use.

  • Third-Party Service Providers: We share necessary data with trusted vendors who assist us in operating our business under strict confidentiality agreements, including:

    • Cloud storage and video hosting platforms.

    • Automated interview scheduling services (e.g., SavvyCal, Calendly).

    • Video editing software and AI transcription processors.

  • Legal Obligations: We may disclose information if required by court order, subpoena, law enforcement request, or to defend against legal claims or protect physical safety.

  • Appearance & Likeness Releases: All video interview participants grant media rights through a separate Talent & Appearance Release Form executed prior to filming.

    • Testimonial Pros will promptly inform the sponsoring Client (the Data Controller).

    • In accordance with our Master Services Agreement, the Client is solely responsible for taking down published media files across their websites, social channels, and marketing platforms.

    • Testimonial Pros will delete or archive the internal project files upon receiving written confirmation from the Client.
